Minimum Wages Act – Overview

Wage Fixation and Revision

Under the Minimum Wages Act, 1948, both Central and State governments share responsibility for determining wage levels. States identify scheduled employments and periodically announce minimum wage rates along with the Variable Dearness Allowance (VDA). Wage boards are constituted to review and revise these rates at regular intervals. Since wages depend on factors such as state, sector, skill level, region, and occupation, there is no uniform national minimum wage, and revision cycles vary across states.

Coverage and Applicability

The Act was enacted to safeguard workers from exploitation through inadequate pay. It applies to all factories, establishments, and business operations across industries. While unscheduled industries are generally excluded, states may extend coverage by specifying occupations or sectors during a revision cycle.

Penalties for Non-Compliance

Failure to pay or underpayment of minimum wages is considered an offence under the Central Act. Penalties can include imprisonment of up to five years and a fine of ₹10,000, as per Section 22 of the Act.
